Introduction

Welcome to Creators Club Private Limited. We respect your privacy and want you to understand how we collect, use, and share data about you, or your child on behalf of whom you are taking our Services from us. This Privacy Policy covers our data collection practices and describes your rights to access, correct, or restrict our use of your personal data.

Creators Club Private Limited (“us”, “we”, “our”, "Jelly" or “CreClub”) operates usecreclub.com and Jelly web application (hereinafter referred to as “Service” or “Platform”).

Our Privacy Policy governs your visit to and/or use of usecreclub.com and Jelly web & mobile application, and explains how we collect, safeguard and disclose information that results from your use of our Service.

We use your data to provide and improve Service. By using Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Our Terms and Conditions (“Terms”) govern all use of our Service and together with the Privacy Policy constitutes your agreement with us (“Agreement”). By visiting and using the Service, you accept and consent to the terms of this Privacy Policy for your use of the Services. We reserve the right to change the terms of this Privacy Policy, at any time. Any such  modifications shall be made effective and binding upon you through posting by CreClub on the Website or through communication via e-mail/SMS to the contact details provided by the User to CreClub. Your continued usage of the Website and Services upon any such change shall be construed as your specific consent to the revised terms of this Privacy Policy.

By using the Services, you agree to the terms of this Privacy Policy. You shouldn’t use the Services if you don’t agree with this Privacy Policy or any other agreement that governs your use of the Services.

1. SCOPE OF THIS POLICY

This Policy is intended to describe our practices with respect to the collection, use, and maintenance of information relating to users of our Service.

Our Platform may contain links to other websites that do not operate under this Policy. These third-party websites may independently solicit and collect personal information from you and, in some instances, provide us with information about your activities on those websites. We encourage you to review the privacy statements of all third-party websites you visit to understand their information practices.

While we strongly support the protection of privacy on the Internet, we do not have control over, and cannot be responsible for, the actions of other third parties. We encourage you to review each such third party’s privacy statement and other otherwise understand its privacy practices, before providing personal information directly to it.

2. DEFINITIONS

SERVICE” means the usecreclub.com website and Cre Club mobile application operated by Creators Club Private Limited as updated from time to time, and any other domains, applications, APIs or other technological tools used by Cre Club to provide you services from time to time.

PERSONAL DATA” means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

USAGE DATA” is data collected automatically either generated by the use of Service or from Service infrastructure itself (for example, the duration of a page visit).

COOKIES” are small files stored on your device (computer or mobile device).

THE USER is the individual using our Service, and who is the subject of Personal Data.

3. Information We Collect and Use

We collect several different types of information for various purposes to provide and improve our Service to you.

3.1 User Data
User Data may contain 'sensitive personal data or information' or 'personal information' as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (‘Data Protection Rules’). We will collect, store, use, process, and transfer such information in accordance with this Privacy Policy. Where CreClub collects or processes User Data, it does so on behalf of the User. User Data may include the following types of data, but is not restricted to User first and last name, account and billing details, e-mail IDs, phone numbers, and other contact information, including profile related information, in addition to the information mentioned in Section I.2. below:
3.1.i All information provided to us by a User when he registers on the Website and/or subscribes to the Services, including name, address, telephone number, email address, gender, company name, etc.
3.1.ii All information that a user chooses to share on the Website such as photos, screenshots, comments, events or other user generated content that may be uploaded on our Website.
3.1.iii Other information such as postal code, password, birthdate, height, weight your gender, education qualifications and proof thereof, mobile number, address and other information you may provide in order to validate your account/use the Services. Your profile picture, if any, along with basic information such as your name/company name may be viewed by other users on the platform as part of your account information.
3.1.iv You may optionally provide us with this information through third-party sign-in services such as but not limited to Facebook, LinkedIn, and Google. In such cases, we procure and store any information about you that is made available to us through these sign-in services.
3.1.v Anonymized Data, as defined in the applicable Terms of Use, which is de-identified, de-aggregated and/or altered such that it cannot be connected or linked to any specific user.
3.1.vi Financial information such as bank details, credit card details, debit card details, account details, PAN card details, GST details, TAN details or electronic wallet details required to transact on the Website.

We collect User Data including personal information and sensitive personal information to operate effectively and provide you with the best experiences with our services. You provide some of this information directly, such as when you create an account, make a purchase, or contact us for support. We get some of your information, such as your IP address, by recording how you interact with our services. We may also get information about you from our business partners or other third parties.

We may receive and collect certain personal information automatically, as outlined elsewhere in this Policy, and including analytics regarding our Websites and Apps, information your Internet browser automatically sends when you visit our Websites and Apps, and information collected by cookies. We may collect personal information that can identify you such as your name and email address, and other information that does not identify you.

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at support@jelly.buzz.

3.2 Information Provided by You and When

The information provided by you would be the User Data. The most common of these circumstances where you would provide User Data  include the following:
3.2.i Making a Purchase: When you place an order online for a product using our Service, you may need to submit personal information/sensitive personal information to us.
3.2.ii Creating an account: To use certain Services of our Platform, or to make purchases, you may be required to create a password-protected user account and provide us with User Data.
3.2.iii Using Our Platform: Our Platform may provide you with the ability to enter (either directly, or by authorizing us to access the information from a third party such as a social networking site or application) certain information such as your contacts, photos, or images you may submit to us to help us locate products for you.
3.2.iv Contacting Customer Service: When you contact our customer service, we may ask you to provide, or confirm, personal information so that we can better serve you.
3.2.v Entering a sweepstakes or contest: If you enter a sweepstakes or contest, we offer, we may ask you to provide personal information so that we can consider your entry and, if you win, so that you may redeem your prize.
3.2.vi Interacting with social networking sites: Our Platform may provide you with the ability to log in/connect/ enter (directly, or by authorizing us to download the information from a third party such as a social networking site or application) User Data  such as contacts or lists of friends. These or related applications may also allow you to provide information directly to social networking sites including information about your purchases, physical location, or comments. If you sign up to receive promotional communications or notifications from us, we may ask you to provide User Data so that we can provide these to you.

3.3 Other Information that We Collect from You

We also may use various technologies to collect information from your computer or device and about your activities on Platform.
3.3.i Log Data: When you use the Services, our servers automatically record information, including information that your browser sends whenever you visit a website or your mobile app sends when you are using it. This log data may include your internet protocol address, the address of the web page you visited before using the Services, your browser type and settings, the date and time of your use of the Services, information about your browser configuration and plug-ins, language preferences, and cookie data, locale and language preferences, and system configuration information.
3.3.ii Device information: We may collect information about the device you are using the Services on, including what type of device it is, what operating system you are using, device settings, application IDs, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you are using and its settings.
3.3.iii Geo-location information: Precise GPS location from devices may be required for effective delivery of the Services, and will as such be collected with your permission. Wi-Fi and IP addresses received from your browser or device may be used to determine approximate location.
3.3.iv Services integrations: If, when using the Services, you integrate with a third-party service, we will connect that service to ours. The third-party provider of the integration may share certain information about your account with CreClub, including certain information about you, including but not limited to your contacts and other "likes". You would also be bound by the privacy policies of these third party services. However, we do not receive or store your passwords for any of these third-party services.
3.3.v Third Party Data: CreClub may also receive information from affiliates in our corporate group, our partners, or others that we use to make our own information better or more useful. This might be aggregate level information, such as which IP addresses go with which PIN/ZIP codes, or it might be more specific information, such as about how well an online marketing or email campaign performed.

3.4 Our Cookie Policy

We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information.

3.4.i Cookies are alphanumeric identifiers or small files that we transfer to your device through your web browser/mobile device to enable our systems to recognise your browser and to provide features such as ‘Recommended for You’, personalised advertisements on other websites. Cookies can be either session cookies or persistent cookies. A session cookie expires when you close your browser and is used to make it easier for you to navigate our website. A persistent cookie remains on your hard drive for an extended period.

3.4.ii CreClub and other service providers we use, (such as Google Analytics, third party advertisers, etc) may use server log files and automated data collection tools like cookies, tags, scripts, customized links, device or browser fingerprints, and web beacons (“Data Collection Tools”) when you interact with/use/access the Services. These Data Collection Tools may automatically track and collect certain information including System Data and Usage Data (as described above) when you use the Services. In some cases, we couple the data gathered through these Data Collection Tools to other data that we may collect.

3.4.iii Most browsers allow you to prevent them from accepting new cookies or disable cookies altogether. Each browser is different; so, check the ‘help’ menu of your browser to learn how to change your cookie preferences. Since cookies allow you to take advantage of some of the website’s essential features, we recommend that you leave them turned on. If you choose to decline cookies, you may not be able to use other interactive features on our Website. However, since there is no universal industry standard for a “do not track” signal, we do not currently obey any such signals/messages from your browsers.

3.4.iv We may use cookies for a number of purposes, including to:
- Provide general internal analytics;
- Study traffic patterns in order to improve Website performance, to customise your experience, and to better match your interests and preferences;
- Keep track of preferences you specify while you are using our Website’s services;
- Support security measures, such as requiring re-login into the website after a certain time period has elapsed;
- Save your username and password, if you login to our Website, so that we can process the saved information and quickly log you into the Website;
- Assist in identifying possible fraudulent activities.

3.4.v We also allow third party advertising and analytics cookies. These are placed by or on behalf of independent advertisers who are advertising on our site. These cookies may be placed within the advertisement and elsewhere on our site. They are anonymous – they cannot identify individuals. Such cookies are used for statistical analysis by allowing the advertiser to count how many people have seen their advertisement, or have seen it more than once. They might also allow the advertiser to tailor advertising to you when you visit other websites.

3.4.vi We also use web beacons (which small objects that allow us to analyse the actions of visitors and Users using the Services) for various purposes including identifying whether a page was visited, a message was opened, advertising more efficiently by excluding/including specific Users/visitors from certain promotional messages, or identifying the source of a new page visit.

3.4.vii We use the following types of cookies:
- Preferences: Cookies which remember information about the browser used, and preferred settings that affect/modify/alter the appearance and behavior of the Services.
- Security: Cookies which enable you to log in and access the Services/Platform; protect from fraudulent logins; and help detect and prevent abuse or unauthorized use of your account.
- Functional: cookies that store functional settings (like the volume level you set for video playback).
- Advertising: Cookies which enable us to serve you advertisements which may be relevant to you and your interests.
- Session State: cookies that track your interactions with the Services to help us improve the Services and your experience, remember details such as login details, and enable processing of your purchases. These are necessary for the Services to work properly, and if you disable them partially or wholly, then certain functionalities will break or be unavailable.
Some third-party partners who provide certain features on our site may also use Local Storage Objects  to collect and store data.We have no access to third party cookies and third-party organisations do not have access to ours. The third-party organisations that place cookies have their own privacy policies.

3.5 Other Data that we collect, and analytics

While using our Service, we may also collect the following information: sex, age, date of birth, place of birth, passport details, citizenship, registration at place of residence and actual address, telephone number (work, mobile), details of documents on education, qualification, professional training, employment agreements, non-disclosure agreements, information on bonuses and compensation, information on marital status, family members, social security (or other taxpayer identification) number, office location and other data. We may also obtain both personal and non-personal information about you from advertising companies, and ad networks business partners, contractors and other third parties and add it to our account information or other information we have collected. Examples of such information that we may receive include: updated delivery and address information, purchase history, and additional demographic information. We may combine this information with information we collect through our Websites and Apps or from other sources.

We also use 3rd-party browser and mobile analytics services including but not limited to Google Analytics, Hotjar, GetSiteControl, Mixpanel, Leadsquared, Wistia, YouTube and Drift on the Services. These services use Data Collection Tools to help us analyze your use of the Services, including information like the third-party website you arrive from, how often you visit, events within the Services, usage and performance data. We use this data to improve the Services, better understand how the Services perform on different devices and provide information that may be of interest to you.

4. USE OF DATA

We use the personal information we collect for a variety of purposes including providing our Services, communicating with you, troubleshooting issues, securing against fraud and abuse, improving and updating the Services, analyzing how you/other visitors use our Services, present personalized advertising, in addition to any uses required by law or necessary for safety and integrity.

4.1 General Uses

We may use information that we collect about you to:
- provide, deliver and maintain our Service;

- allow you to participate in interactive features of our Service when you choose to do so;

- Tailor advertisements across devices;Improve our Services and develop new products, services, and features;
- Analyze trends and traffic, track purchases, and track usage data;
- Advertise the Services on third-party websites and applications;
- As we, in our sole discretion, otherwise determine to be necessary to ensure the safety or integrity of our users, employees, third parties, the public, or our Services;
- for any other purpose with your consent.

4.2 Retention of Data

We will retain your information pertaining to you only for as long as is necessary for the purposes set out in this Privacy Policy. We will also retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes for as long as we may require.

4.3 Transfer of Data / Sharing of Personal Information

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. We share your personal information as necessary to provide the services you request, including sharing information with third party service providers; when required by law; to protect rights and safety, and with your consent.

We may share personal information with:

4.3.i Authorized service providers: We may share your personal information with our authorized service providers that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, delivering packages, providing customer service and marketing assistance, performing business and sales analysis, data analysis, supporting our Platform functionality, and supporting contests, promotions, sweepstakes, surveys and other features offered through our Platform. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

4.3.ii Business partners: When you make purchases or engage in promotions offered through our Platform, we may share personal information with the businesses with which we partner to offer you those products, services, promotions, contests and/or sweepstakes. When you elect to engage in a particular merchant's offer or program, you authorize us to provide your email address and other information to that merchant.

4.3.iii Third parties’ advertisers on our Platform: We may allow third-parties, advertising companies, and ad networks, to display advertisements on our Websites and Apps. These companies also may use tracking technologies, such as cookies, to collect information about users who view or interact with their advertisements. They may collect information about where you, or others who are using your computer, saw and/or clicked on the advertisements they deliver, and possibly associate this information with your subsequent visits to the advertised websites. They also may combine this information with other personal information they collect from you or from other third parties.

4.3.iv With Analytics and Data Enrichment Services: As part of our use of third-party analytics tools like Google Analytics and data enrichment services like Clearbit or Pipl, we share certain data, or de-identified data as needed.

4.3.v To Power Social Media Features: The social media features in the Services (like the Facebook Share) may allow the third-party social media provider to collect information including your IP address, which page of the Services you’re visiting, etc., and to set a cookie to enable the feature. Your interactions with these features are governed by the third-party company’s privacy policy.

4.3.vi For Advertising: We may use and share certain data with third-party advertisers and networks to show general demographic and preference information among our users. We may also allow advertisers to collect Data through Data Collection Tools, and to use this data to offer you targeted ad delivery to personalize your user experience (through behavioral advertising) and also to undertake web analytics.

4.3.vii For Security and Legal Compliance: We may disclose your data to third parties if we (in our sole discretion) believe in good faith, that the disclosure is:
- Permitted or required by law; including any order or proceeding
- Required to enforce our Terms of Use, Privacy Policy, and other legal agreements;
- Required to detect, prevent, or address fraud, abuse, misuse, potential violations of law (or rule or regulation), or security or technical issues;

4.3.viii During a Change in Control: If CreClub undergoes a business transaction like a merger, acquisition, corporate divestiture, or dissolution (including bankruptcy), etc, we may share, disclose, or transfer all of your data to the successor organization during such transition or in contemplation of a transition (including during due diligence).

4.3.ix After Aggregation/De-identification:
we can disclose or use aggregate or de-identified data for any purpose.

4.3.x With Your Permission: with your consent, we may share data to third parties outside the scope of this Privacy Policy.

4.3.xi Other situations: We also may disclose your information:

4.3.xiii Aggregated and Non-personal Information:We may share aggregated and non-personal information we collect under any of the circumstances set forth in this Policy. We may also share it with third parties to develop and deliver targeted advertising on our Websites and Apps and on websites and apps of third parties. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated information with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis. For example, we may tell our advertisers the number of visitors to our Websites and Apps and the most popular features or services accessed. This information does not contain any personal information and may be used to develop website content and services that we hope you and other users will find of interest and to target content and advertising.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

4.4 Storage of Information

Creators Club Private Limited will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. Your information collected by us may be stored by us or our affiliates, business partners, suppliers and sub-contractors. Information may also be stored in or outside India.

Your information shall be stored only for the period necessary for purposes specified hereinabove.

By visiting, accessing and/or using the Website and/or submitting your information, you consent to such storage of your information, including your Personal Information and Usage Data.

5. PAYMENTS

We may provide paid products and/or services within Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. We use the following payment processors: RazorPay, Visa, MasterCard, Rupay, and American Express.

6. YOUR RIGHTS AND CHOICES

6.1 Opt-Out

At any time you can choose to no longer receive commercial or promotional emails or newsletters from us by modifying your email preferences by selecting the "Opt-Out" link found in the footer of the communication or on our Websites or Apps and following the instructions or contacting us. When you register on our Platform , you will be given a choice as to whether you want to receive e-mail messages about special offers and deals related to your interest. You may modify your choice at any time by using the "Opt-Out" link as described above.

You also will be given the opportunity, in any commercial e-mail that we send to you, to opt out of receiving such messages in the future. It may take up to thirty (30) days for us to process an opt-out request. We may send you other types of transactional and relationship e-mail communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt out of receiving them. Please note that changing information in your account, or otherwise opting out of receipt of promotional email communications will only affect future activities or communications from us. Even if you opt-out of receiving promotional communications, you may continue to receive emails and notifications relating to order confirmations, back order notifications, membership information, and/or other business-related communications and other communications in relation to your use of our Services.
